Please read these Terms carefully. By accessing or using Maracim, you agree to them. If you do not agree, do not use the service.
1. Agreement and eligibility
These Terms of Use (“Terms”) apply to your use of maracim.com, the Maracim mobile application, and related services (together, the “Service”). “Maracim,” “we,” “us,” and “our” refer to the provider of the Service.
You must be legally capable of entering into an agreement in your jurisdiction to use the Service. If you use Maracim on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms.
2. Accounts
Some features may require an account. You agree to provide accurate information, keep it current, protect your login credentials, and notify us promptly of suspected unauthorized access. You are responsible for activity that occurs through your account unless prohibited by applicable law.
3. Acceptable use
You may use Maracim for personal planning and other purposes we expressly permit. You agree not to:
- Use the Service unlawfully, fraudulently, or to harm another person.
- Interfere with the Service, bypass security controls, or attempt unauthorized access.
- Copy, scrape, reverse engineer, or commercially exploit the Service except where law expressly permits.
- Upload malicious code, impersonate others, or provide misleading information.
- Infringe intellectual property, privacy, publicity, or other rights.
- Use automated methods to access the Service without our written permission.
4. Vendors and third-party services
Maracim may help you discover, compare, save, or contact independent venues and service providers (“Vendors”). Unless we explicitly state otherwise, Maracim is not a party to agreements between you and a Vendor and does not provide the Vendor’s services.
Vendor availability, pricing, descriptions, images, policies, and performance are controlled by the relevant Vendor and may change. You are responsible for reviewing terms, verifying details, and deciding whether a Vendor is right for you before making a booking or payment. Any dispute about a Vendor’s services should be addressed with that Vendor, without limiting rights you may have under applicable law.
5. Your content and Maracim’s rights
You keep ownership of content you submit, such as notes, preferences, reviews, images, or messages (“Your Content”). You grant Maracim a limited, worldwide, non-exclusive license to host, store, reproduce, and display Your Content only as needed to operate, protect, and improve the Service or as you direct.
You confirm that you have the rights needed to submit Your Content. You may not upload content that is unlawful, harmful, misleading, or infringes another person’s rights.
The Service—including its software, design, branding, text, and other materials—is owned by Maracim or its licensors and protected by applicable law. These Terms do not transfer ownership of the Service to you.
6. Service availability and disclaimers
We work to keep Maracim useful, accurate, and available, but the Service may sometimes be interrupted, changed, or contain errors. To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
Planning tools, suggestions, timelines, and budgets are provided for convenience and do not replace your own judgment or professional advice. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
7. Limitation of liability
To the fullest extent permitted by law, Maracim and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from your use of the Service or interactions with Vendors.
Where liability cannot be excluded, it will be limited only to the extent allowed by applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Suspension and termination
You may stop using Maracim at any time. We may suspend or end access when reasonably necessary to protect the Service or its users, respond to legal requirements, address material or repeated violations of these Terms, or discontinue the Service. Where appropriate, we will provide notice.
9. Account deletion
You may request permanent deletion of your Maracim account and associated personal data. Deletion is generally irreversible and may remove your profile, planning information, saved vendors, favorites, preferences, and other account-linked content.
Limited information may be retained where reasonably necessary for legal compliance, fraud prevention, dispute resolution, transaction records, or enforcement of these Terms. Review our Privacy Policy and use the public account deletion page to initiate a request.
10. Changes to Maracim or these Terms
We may update the Service and these Terms as Maracim evolves. Updated Terms will be posted here with a new effective date. If a material change affects your rights, we will provide additional notice when appropriate. Continuing to use the Service after updated Terms take effect means you accept them.
If any part of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
